Like many recent works in legal theory, especially those focusing on the apparently conflicting schools of legal positivism and natural law, Waluchow’s Inclusive Legal Positivism begins by admitting a degree of perplexity about the field; indeed, he suggests that the field has fallen into “chaos”. Disturbingly, those working within legal theory appear most uncertain about what the tasks of their field are. Legal philosophers often seem to suspect strongly that at least their colleagues in the field are confused about those (...) tasks. As a result, many recent books in legal theory are in large part exercises in legal metatheory, devoting many pages to attempts to define the purposes and goals of the field. Waluchow follows this trend and begins by expressing a desire to clarify the issues that separate those trying to give an account of the nature of law. His ultimate goal is to defend a version of legal positivism, inclusive legal positivism, that he thinks is at least implicit in H. L. A. Hart’s work. (shrink)

Plan-ahead becomes necessary for those movements which are over-and-done in less time than it takes for the feedback loop to operate. Natural selection for one of the ballistic movements (hammering, clubbing, and throwing) could evolve a plan-ahead serial buffer for hand-arm commands that would benefit the other ballistic movements as well. This same circuitry may also sequence other muscles (children learning handwriting often screw up their faces and tongues) and so novel oral-facial sequences may also benefit (as might kicking and (...) dancing). An elaborated version of the sequencer may constitute a Darwin Machine that spins scenarios, evolves sentences, and facilitates insight by offline simulation. An example is given of an evolutionary scenario from an apelike ancestor, demonstrating the transition behaviors and growth curve considerations that any such theory needs to have; this particular scenario (involving throwing improvements) also suggests an explanation for the puzzling design of the Acheulean "handaxe.". The question to which I should like to address my remarks asks, as I understand it, whether philosophical knowledge can attain a truth which is not merely independent of individual men but of human nature and the human situation in general. To attempt to say anything decisive about the nature of philosophical knowledge in a few pages would be to court disaster. The most one might hope to do is to make some suggestions, and it is as suggestions that I (...) would like to offer the reflections which follow. Yet even the most tentative exploration of a philosophical problem cannot avoid prejudicing somewhat the issues it proposes to investigate, for every question determines to some extent what will count as an acceptable answer. I should, therefore, like to indicate at the outset the context of meaning in which my remarks are intended to be read. To me the question, “Is philosophy transcendental?” has a definite Kantian ring, and it is within the universe of discourse constituted by the critical philosophy that I should like to begin my discussion. William of Poitiers began his career as a knight before studying in the schools of Poitiers and entering the Church. He became a chaplain in the household of William the Conqueror, and was able to give a first-hand account of the events of 1066-7. The Gesta Guillelmi, his unfinished biography of the king, is particularly important for its detailed description of William's campaigns in Normandy, the careful preparations he made for the invasion of England, the battle of (...) Hastings and the establishment of Norman power after the Conquest. It is a mine of information of military tactics and the conduct of war in the eleventh century. Though written from the point of view of the Norman court, it gives what is probably the most authentic account of these momentous events. This edition, by the late R. H. C. Davis and Marjorie Chibnall, with facing-page English translation of the Latin text, provides the first complete English translation, as well as a full historical introduction and detailed notes. In “The logic of deep disagreements” (Informal Logic, 1985), Robert Fogelin claimed that there is a kind of disagreement – deep disagreement – which is, by its very nature, impervious to rational resolution. He further claimed that these two views are attributable to Wittgenstein. Following an exposition and discussion of that claim, we review and draw some lessons from existing responses in the literature to Fogelin’s claims. In the final two sections (6 and 7) we explore the role reason can, (...) and sometimes does, play in the resolution of deep disagreements. In doing this we discuss a series of cases, mainly drawn from Wittgenstein, which we take to illustrate the resolution of deep disagreements through the use of what we call “rational persuasion.” We conclude that, while the role of argumentation in “normal” versus “deep” disagreements is characteristically different, it plays a crucial role in the resolution of both. We propose that assessments must be based on actual cognitive processes used in performing each step of a task. Complexity comparisons are important for the orderly interpretation of research findings. Taking credit is the process through which organizational members claim responsibility for work activities. We begin by describing a publically disputed case of credit taking and then draw on psychological, situational, and personality constructs to provide a model that may explain when and why organizational members are likely to take credit. We identify testable propositions about the credit-taking process, discuss ethical aspects of credit taking and suggest areas for research on credit taking in organizations.

The project began in the 1960s, and the initial results for the Middle Ages were published sequentially as articles in Traditio between 1967 and 1974, and the inventory for the period from 1500 to 1650 appeared in Studies in the Renaissance and Renaissance Quarterly between 1974 and 1981. The project was modeled along the lines of two great research tools achieved earlier in the twentieth century at Freiburg by Friedrich Stegmüller, namely his Repertorium Commentariorum in Sententias Petri Lombardi (1947) and his Repertorium Biblicum Medii Aevi (1940–). Now, through the Unione Accademica Nazionale and SISMEL, both of Lohr's inventories in revised and expanded form are being published as stand-alone volumes. The first two that appeared were Latin Aristotle Commentaries, II: Renaissance Authors (Subsidia VI, 1988), followed by Latin Aristotle Commentaries, III: Index initiorum—index finium (Subsidia X, 1995). The two volumes being reviewed here are the next two installments.The first of these, the Bibliography of Secondary Literature, is a much-expanded version of Lohr's Commentateurs d'Aristote au moyen-âge latin: Bibliographie de la littérature secondaire récente, Vestigia 2 (Fribourg-Paris, 1988). The intent of that volume was, as the title indicates, to provide a list of the scholarly literature on Aristotelian commentaries since the publication of the articles in Traditio, as well as some older literature that had not been included earlier in the entries for each author. The present version of this work is more than twice as large as the 1988 version, adding books and articles that were missed in the earlier bibliographies as well as publications since 1986 (the cutoff date for the earlier edition). Moreover, the Commentateurs d'Aristote provided a bibliography only for medieval commentaries, while the new Bibliography of Secondary Literature begins with a section covering literature about translations of the works of Aristotle and their Wirkungsgeschichte, then [End Page 141] the section for the literature on medieval authors, and finally the section for bibliography on Renaissance authors.The organization of the bibliography for authors that have generated extensive literature is more complex than for the others. The longer bibliographies are divided into works concerned with biographical information and manuscripts; general accounts; and, depending on the contributions of a specific author, sections on logic, metaphysics, natural philosophy, and practical philosophy. Within each of these sections the literature is arranged by date of publication, moving from the older to the most recent (limited, of course, by the cutoff date at which this volume was prepared for publication, apparently around 2003). The principle of inclusion was broad, citing works that relate tangentially to the subject areas of Aristotelian philosophy mentioned. And although bibliographies of this kind should be made available on the Internet, where they can be continually expanded and updated, it is useful and pleasurable to have such a volume on the shelf at one's fingertips, particularly for those of us still attuned to a print culture.The other volume, Latin Aristotle Commentaries, I.2: M–Z, published in 2010, is the second half of the revised edition of medieval authors and their commentaries on Aristotle's works. Some bibliography is included here in the individual entries, but only what relates to the manuscripts. Morisato's stated objective in the introduction is (a) to investigate the possibility of comparative philosophy through William Desmond's metaxological way of thinking, and (b) to examine how the "absolute dialectic" in Tanabe Hajime's metanoesis can help us understand the relationship between one framework of thinking and another (p. 16). Morisato's book proceeds in five parts. Part One orients the reader to the scope of the project through an overview of comparative philosophy and its methodological frameworks--namely, the metaxological methodology of William Desmond, which deals importantly with the (modern) predicament of religion as expressed in the "transcendental univocity" of the Kantian system; and the metanoetic methodology of Tanabe Hajime, which deals importantly with the issue of "rational progress" in Hegelian dialectic. Yet each intellectual framework deals with both Kant's and Hegel's systems. Part Two addresses what the problem of religion in Kantian and Hegelian philosophy is in more detail. Part Three, "Metaxology and the Problems of the Philosophy of Religion," and Part Four, "Metanoetics and the Problems of the Philosophy of Religion," offer a more detailed account concerning how Desmond's and Tanabe's philosophies tackle conceptual problems in modern philosophy of religion. Morisato's conclusion follows from these along with an endnotes section, bibliography, and index.According to Morisato, overcoming the problem of comparative philosophy--i.e., the "philosophical problem of comparing two systems of thinking rooted in different cultural and intellectual contexts" (p. 22)--means, at least in part, clarifying the extent to which philosophers of different culturalintellectual contexts and backgrounds share, as "kindred spirits" or as "intellectual companions," a consonance of thought regarding their philosophical perspectives. Desmond and Tanabe represent just such a pair, whose consonance of thought, expressed by Morisato en passant and expressed more definitively in the conclusion, is unified in a struggle against hegemonic structures in the [End Page 1] philosophy of religion, specifically those of Kant's and Hegel's philosophies of religion. William Desmond (1951–present) is a Catholic philosopher who currently holds the David R. Cook Chair in Philosophy at Villanova University. He has worked extensively on metaphysics, ontology, philosophy of religion, aesthetics, and German idealism. Tanabe Hajime (1885–1962) was a Japanese philosopher of the Kyoto school and is perhaps most well-known for his Philosophy as Metanoetics. Morisato does a commendable job elucidating issues in modern systems of religion, which have undoubtedly been influenced by Kant's and Hegel's systems. As it concerns Kant, contemporary philosophy of religion still struggles with the claims of transcendental idealism, particularly its reduction of religious belief to mere postulates of practical reason. And as it concerns Hegel, what seems to be an unending, "progressive" self-return of dialectical monism has deeply influenced the way, and manner, in which religious adherents deal with societal views of the individual and individuals' views of society. By this token, Morisato's attempt to get beyond the so-called "extirpation" of the source of religious truth as the "creative power behind our understanding of reality and our existence" is refreshing, to say the least (p. 46). In what follows, I offer a relatively brief overview of Morisato's book and conclude with a reflection on the text.Morisato's critique of the Kantian and Hegelian systems begins with the argument that Kantian transcendental univocity implies that reason's autonomy, as dictates of the moral law as absolute duties, not only precedes divine legislation, but becomes one with it or else is reduced to it. In other words, for Kant, the rational-moral universal is divine law. However, reason's autonomy fails to comprehend the divine origination of finite particulars due to... (shrink)

This study examines the influence of ethics instruction, religiosity, and intelligence on cheating behavior. A sample of 230 upper level, undergraduate business students had the opportunity to increase their chances of winning money in an experimental situation by falsely reporting their task performance. In general, the results indicate that students who attended worship services more frequently were less likely to cheat than those who attended worship services less frequently, but that students who had taken a course in business ethics were (...) no less likely to cheat than students who had not taken such a course. However, the results do indicate that the extent to which taking a business ethics course influenced cheating behavior was moderated by the religiosity and intelligence of the individual student. In particular, while students who were highly religious were unlikely to cheat whether or not they had taken a business ethics course, students who were not highly religious demonstrated less cheating if they had taken a business ethics course. In addition, the extent of cheating among highly intelligent students was significantly reduced if such students had taken a course in business ethics. Likewise, individuals who were highly intelligent displayed significantly less cheating if they were also highly religious. The implications of these findings are discussed. (shrink)

This study examined whether undergraduate students’ perceptions regarding the acceptability of cheating were influenced by the amount of ethics instruction the students had received and/or by their personality. The results, from a sample of 230 upper-level undergraduate students, indicated that simply taking a business ethics course did not have a significant influence on students’ views regarding cheating. On the other hand, Machiavellianism was positively related to perceiving that two forms of cheating were acceptable. Moreover, in testing for moderating relationships, the (...) results indicated that the extent to which taking a business ethics course influenced attitudes varied substantially across individuals. Specifically, taking a course in business ethics did result in students who scored lower on Machiavellianism holding even more negative views regarding certain forms of cheating. In addition, individuals with higher grade point averages (GPAs) who had taken a course in business ethics were also less accepting of certain forms of cheating than individuals with similar GPAs who had not taken the business ethics course. Calpain (Cp) is a calcium (Ca2+)‐dependent cysteine protease. Activation of the major isoforms of Cp, CpI and CpII, are required for a number of important cellular processes including adherence, shape change and migration. The current concept that cytoplasmic Cp locates and associates with its regulatory subunit (Rs) and substrates as well as translocates throughout the cell via random diffusion is not compatible with the spatial and temporal constraints of cellular metabolism. The novel finding that Cp and Rs function relies upon (...) tenacious hydrophobic interactions with organelle membranes offers a unifying explanation for the paradoxical and puzzling features of Cp activation and regulation such as how nM concentrations of intracellular Ca2+ can activate Cp molecules requiring μM to mM concentrations of Ca2+ for in vitro activation, and how this protease can spatially and temporally locate specific substrates and translocate throughout the cell. We hypothesize that Cp and its regulatory moieties associate with organelles to facilitate the activation of this protease resulting in the cleavage of substrates and aid in its translocation throughout the cell. In order for theology to have a cognitive dimension, it is necessary to have procedures for testing and critically evaluating theological models. We make use of certain features of scientific models to show how science has been able to move beyond the poles of foundationalism, represented by logical positivism, and antifoundationalism or relativism, represented by the sociologists of knowledge. These ideas are generalized to show that constructing and testing theological models similarly offers a means by which theology can move beyond (...) confessionalism and postmodernism. Our starting point is Paul Tillich's concept of God as the ground of being and the different levels of consciousness and thinking that accompany his understanding of theology. The ontological argument of Anselm is shown to play a key role, not as a proof for the existence of God but as a means for testing theological models. An example of a theological model, drawn from the domain of philosophy of science, is presented to show how theological models are constructed and tested. (shrink)

Anime is exploding on the worldwide stage! Anime has been a staple in Japan for decades, strongly connected to manga. So why has anime become a worldwide sensation? A cursory explanation is the explosion of online streaming services specializing in anime, like Funimation and Crunchyroll. Even more general streaming services like Netflix and Amazon have gotten in on the game. Anime is exotic to Western eyes and culture. That is one of the reasons anime has gained worldwide popularity. This strange (...) aesthetic draws the audience in only to find it is deeper and more sophisticated than its surface appearance. Japan is an honor and shame culture. Anime provides a platform to discuss “universal” problems facing human beings. It does so in an amazing variety of ways and subgenres, and often with a sense of humor. The themes, characters, stories, plotlines, and development are often complex. This makes anime a deep well of philosophical, metaphysical, and religious ideas for analysis. International scholars are represented in this book. There is a diversity of perspectives on a diversity of anime, themes, content, and analysis. It hopes to delve deeper into the complex world of anime and demonstrate why it deserves the respect of scholars and the public alike. (shrink)

This study examined some ethical implications of two different individual competitive orientations. Winning is crucially important in hypercompetitiveness , whereas a personal development (PD) perspective considers competition as a means to self-discovery and self-improvement. In a sample of 263 senior-level undergraduate business students, survey results suggested that hypercompetitiveness was generally associated with “poor ethics” and PD competitiveness was linked with “high ethics”. For example, hypercompetitive individuals generally saw nothing wrong with self-interested gain at the expense of others, but PD competitors (...) viewed such activities as largely inappropriate. Hypercompetitive people also tended to be highly Machiavellian but not ethically idealistic. In contrast, PD competitors tended to be ethically idealistic but not Machiavellian. Managers that are interested in both high ethics and high functioning work groups may wish to consider the potential importance of attempting to channel hypercompetitive tendencies into PD directions. Initially he was reluctant to do so since he feared undertaking them would divert him from developing rigorously and systematically (...) some metaphysical ideas of his own that had preoccupied him for some time. [End Page 130]In the end, however, he relented and in the spring of 1908 gave the lectures which were subsequently published as A Pluralistic Universe.As it happened, though, in the course of these lectures James presented some of those metaphysical ideas, though in a popular and informal style appropriate to lecturing. Later on he did get down to working out a systematic metaphysics in proper academic style, but the project was cut short by his untimely death in 1910. The incomplete Some Problems of Philosophy,posthumously published in 1911, recapitulates some major themes of A Pluralistic Universe.When James addressed his Oxford audience, the time was ripe for the advancement of his own brand of metaphysical pluralism and radical empiricism in opposition to the still-regnant forms of monistic idealism as represented by Bradley, Green, and Royce. The hegemony in the philosophical world long enjoyed by idealism was beginning to break up—something noted by James in his first lecture—due in no small part to the very ideas aired in his lectures and the then newly emerging schools of pragmatism and realism. The period between 1914 and 1918 not only rings the death knell of European imperialism but also, significantly, marks the watershed between nineteenth-and twentieth-century philosophy.The argument of A Pluralistic Universerevolves around the Parmenidean conundrum of the one-and-the-many. It is the solution to this problem that was the main bone of contention between James and absolute idealists like F. H. Bradley, T. H. Green, and Josiah Royce. For them, the world in reality is but one thing, though appearing illusorily as many, with a pervasive unity throughout—it is a "block-universe," to use James's expression for it; for James, by contrast, the world is irreducibly many things whose unities are partial and shifting. The gravamen of James's objections to absolute idealism was its monism, though he objected no less strenuously to other ideas associated with it: its doctrine of internal relations; its determinism; and, in particular, its deprecation of experience in favor of concepts (what James condemns as "vicious intellectualism"). James proposed, against this monolithic idealism, the alternative hypothesis of metaphysical pluralism. Here he affirmed the reality of external relations (particularly conjunctions) among things and the continuities within experience, thereby making his empiricism "radical." He approached experience phenomenologically, finding it, not concepts, to be constitutive of reality, the value of concepts being more practical than theoretical. He conceived of the universe as being open-ended, where human agency can make a difference for the better.A subtext of A Pluralistic Universeis James's advocacy of something like [End Page 131]traditional theism in contradistinction to the pantheism of absolute idealism. He rightly notes that the Absolute is not the God of Christianity.
